Elder Guard – Terms and Conditions 

These Terms and Conditions (“Terms”) govern the purchase, use, and subscription of personal alarm devices and services provided by Elder Guard (“we”, “us”, “our”). By purchasing, activating, or using an Elder Guard personal alarm or monitoring service, you agree to be bound by these Terms. 

If you do not agree with these Terms, you should not use our products or services.  

  1. AboutElder Guard 

Elder Guard is a UK-based provider of personal alarm (SOS alarm) devices and related support services designed to assist individuals during emergency situations. Our registered office is located in the United Kingdom.  

  1. Our Services

Elder Guard provides personal safety and medical alert solutions, including SOS alarms, wearable pendants, and related services. Depending on your chosen plan, services may include: 

  • Emergency alert activation 
  • 24/7 monitoring support 
  • Notifications to nominated contacts 
  • Location services (where supported by the device) 

Our services are intended to support users during emergencies but do not replace medical professionals or emergency services.  

  1. Eligibility and Use

Our products and services are intended for individuals aged 18 or over. Where a user is unable to manage their service independently, a family member, carer, or authorised representative may manage the account on their behalf. 

Users must follow all instructions provided with the device to ensure proper operation.  

  1. Device Performance and Limitations
  • Elder Guard personal SOS alarm relies on batteries, mobile networks, and GPS to send alerts. When activated, our monitoring team quickly contacts emergency services or your loved ones to get help 
  • No personal alarm system can guarantee detection of every fall or emergency. 
  • Users should always contact emergency services directly if able. 
  • We take reasonable steps to ensure our website is available at all times; however, access may occasionally be limited to carry out maintenance, updates, or repairs. Any such interruptions will be kept to a minimum where possible 

.Elder Guard is not responsible for service interruptions caused by network failures, environmental conditions, improper use, or circumstances beyond our reasonable control  

  1. Emergency Response

When an SOS alert is activated: 

  • The Elder Guard response team or monitoring service (where applicable) will act according to your Emergency Care Instructions. 
  • Assistance may include contacting emergency services, nominated contacts, or both. 

Elder Guard does not provide medical advice, diagnosis, or treatment and cannot guarantee response times of third-party emergency services.  

  1. Subscriptions, Payments, and Charges
  • Some Elder Guard services require an ongoing subscription. 
  • Prices, billing cycles, and payment terms are displayed clearly at the time of purchase. 
  • Payments must be made in accordance with your selected plan to maintain service continuity. 

All charges are inclusive of VAT unless otherwise stated.  

  1. Cancellation and Termination

You may cancel your subscription on line or by calling our customer Support with the terms provided at the point of purchase. 

Elder Guard reserves the right to suspend or terminate services where: 

  • These Terms are breached 
  • Payment obligations are not met 
  • The service is misused 
  • Continued use poses a risk to the user or others 

Any outstanding fees remain payable following termination.  

  1. Returns and Refunds

Returns and refunds are provided in accordance with: 

  • The Consumer Rights Act 2015 
  • The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 

Full return and refund details are provided during purchase.  

  1. Data Protection and Privacy

Elder Guard processes personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 

  • Elder Guard acts as a data processor where applicable. 
  • Personal and medical information is handled securely and confidentially.

  1. User Responsibilities

Users agree to: 

  • Provide accurate and up-to-date personal and emergency contact information 
  • Keep Emergency Care Instructions current 
  • Use the device responsibly and for its intended purpose 
  • Notify Elder Guard of any changes that may affect service delivery  
  1. Intellectual Property

All content, trademarks, logos, software, and materials related to Elder Guard products and services remain the intellectual property of Elder Guard and may not be copied or used without prior written consent.  

  1. Limitation of Liability

To the maximum extent permitted by UK law: 

  • Elder Guard is not liable for indirect or consequential losses 
  • We are not responsible for failures caused by circumstances beyond our reasonable control 
  • Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law  
  1. Force Majeure

Elder Guard shall not be liable for delays or failures caused by events beyond our reasonable control, including but not limited to natural disasters, power outages, network failures, or acts of government.  

  1. Changes to These Terms

We may update these Terms from time to time. Any changes will be published on our website. Continued use of Elder Guard products or services constitutes acceptance of the revised Terms.  

  1. Governing Law

These Terms are governed by and interpreted in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
